Tekayha Hamilton and her son were awarded $1.3 million by a jury in their medical malpractice lawsuit against the Reginal Medical Center (“RMC”) in Orangeburg County, South Carolina. When the son was only 1 month-old, he was admitted into RMC with a fever of nearly 103 degrees. During his treatment, the child suffered from “IV infiltration,” which is when the IV drip doesn’t enter the bloodstream properly and seeps into the skin and muscle in the area.
When this happens, it leaves the area swollen and the skin dead. This often results in a patient with permanent disfigurement of the area. In this case, the child left the hospital with a permanently disfigured hand. The suit alleged that the hospital was negligent in their treatment of the child, which has left him with a diminished enjoyment of life, substantial medical expenses and emotional distress, along with the permanent scarring and impairment of his hand.
RMC argued that the cause of these injuries was a natural disease and that the child was at least equally as negligent as the hospital. They further argued that the treatment and standard of care used by their medical professionals was more than adequate. The hospital records show that when the boy became fussy, the IV was discontinued and a dressing was applied to the area that had become swollen. It wasn’t until the child was in pain for about two hours after the IV was removed that the doctors noticed the area had darkened.
