Federal Government Settles Medical Malpractice Lawsuit Paying Victims $5 Million.

The federal government will pay $5 million to resolve a medical malpractice suit accusing doctors at a Florida naval hospital of failing to order a cesarean section despite signs of fetal distress which caused a baby’s permanent brain damage. Jenifer and Sean Mochocki, a U.S. Air Force officer, and the federal government asked U.S. District Court Judge Marcia Morales Howard to approve a settlement to end a medical malpractice suit alleging that three Naval Hospital Jacksonville doctors failed to order a C-section despite adverse fetal heart tracing test results, which purportedly resulted in a brain injury caused by oxygen deprivation.

Under terms of the deal, $1.59 million will be paid upfront to the Mochockis, about $3 million will be allocated to purchase an annuity that would provide monthly payments of approximately $7,600 for the rest of the child’s life, and an additional monthly payment of about $4,500 will be made when the child reaches the age of 18 until the end of his life. The government agreed to pay Jenifer Mochocki four annual payments of approximately $35,000, starting in 2034, while Sean Mochocki will receive $129,000 in 2033 for their respective pain and suffering.
