Having a child can be one of the most exciting and exhilarating experiences a person can go through. When your baby is wrongfully injured by the negligence of another person, however, it can become one of the most tragic and frightening experiences of your life. Soon to be parents trust medical providers to utilize their knowledge, skill and available technology to detect any potential problems and to make sure that the birthing process is carried out smoothly and properly. If there is an oversight or a mistake during the delivery process, serious, life-long injuries can result. When that happens, the doctors involved in the medical malpractice may be held accountable for the personal injuries they cause.
This was, unfortunately, the case for one California couple. Andrew and Jennifer Blunt sued Dr. Haupt on behalf of their daughter, Sofia Blunt, after a birthing complication left Sofia with cerebral palsy. Cerebral palsy develops after an injury to the brain and results in loss of control of movement, balance, and posture. Many cases also have life-long seizure issues that make it difficult for the patient to think or reason. The Blunts alleged that their doctor acted negligently while delivering Sofia, and caused the injuries that resulted in her cerebral palsy.
According to sanluisobispo.com, a local jury agreed with the Blunts and found that their doctor’s actions constituted negligence and directly caused their daughter’s injuries. As a result, the Blunts were awarded $74,225,000 in personal injury damages, including pain and suffering and future medical expenses. The family intends to use the funds to help treat their daughter’s condition and give her as much of a normal life as possible.
