Medical Practitioners In Philadelphia Worry New Proposal Would Dangerously Increase Number Of Medical Malpractice Claims Brought.

Medical malpractice claims serve a number purposes, including holding doctors accountable for negligent behavior, and compensating patients for injuries suffered as a result of such behavior. For obvious reasons, many doctors would like as few of these claims allowed as possible, while injured patients would like as much flexibility as possible in bringing such a suit. This tension causes lawmakers and courts to take policy considerations into account when determining the appropriate standards for bringing such a claim. If negligent behavior by a medical professional does occur, and results in injury, it would be wise to contact an expert medical malpractice attorney at 617-787-3700.

In the early 2000’s, Philadelphia courts became notorious for allowing a large number of medical malpractice claims to come through, and for returning large verdicts for plaintiffs. As a result, plaintiff’s attorneys began filing their suits in Philadelphia, regardless of where the injury occurred. Recognizing that this “venue shopping” practice was becoming a problem, the Philadelphia legislature passed a law requiring such claims to be brought in the county in which they occurred. The following year, the number of medical malpractice claims in Philadelphia was cut nearly in half.

There is now a proposal to repeal this law, and allow medical malpractice claims to be brought in Philadelphia regardless of where the injury occurred. Physicians and commentators worry that not only would an influx of less meritorious cases be brought, but medical practitioners will leave the area to avoid such suits. There is also a concern that the return of venue shopping for medical malpractice claims will clog the court system and lower efficiency. Both sides of the issue are fighting fiercely, and Philadelphia has become their battle ground.

Ex-Prisoner Settles Medical Malpractice Case For $1.3 Million

There are a number of serious concerns with the current state of the U.S. prison system, including overcrowding, high recidivism rates, and racial bias being chief among them. Another problem that may go unnoticed is the quality (or lack thereof) of the medical attention that inmates receive. Although many prisoners are deservingly in jail for their crimes, that does not mean that they should be denied basic medical attention. Unfortunately, in many cases, prisoners receive little or no attention for serious conditions. In such a situation, it would be wise to contact an expert medical malpractice attorney at 617-787-3700.

For almost three years, Wayne World suffered from subcutaneous lymphoma, a rare form of skin lymphoma. However, during this period, he was mistakenly being treated for psoriasis, a far less serious skin condition. World has become increasingly debilitated over the past several years, and his 17-year sentence was cut short due to medical concerns.

Legislators have long noted a “pattern of deficient medical care behind bars.” Uconn Health, a major contractor for corrections departments, has been a defendant in 25 lawsuits, including 8 deaths, for situations similar to that of Wayne World. According to reports, Uconn Health’s contract lacks basic measures for quality control and oversight. World’s attorneys, Kenneth Krayeske and Devaughn Ward, have also noted that they have received an influx of medical malpractice cases for prisoners in recent years. World’s case settled for $1.3 million.

City of Lincoln, Nebraska Accused Of Negligence After Fatal Explosion.

Because explosions are often associated with the fictional narratives of action movies, when one occurs in real life, people cannot help but assume foul play. However, due to the massive amounts of complex machinery and chemicals that companies and manufacturers use to run their businesses, explosions can be accidental in many instances, albeit caused by the negligence of someone else. In such a situation, it may be wise to contact an expert explosion injury attorney at 617-787-3700.

On August 14, 2017, a natural gas explosion occurred in Lincoln, Nebraska that led to the deaths of Jeanne and Jimmy Jassa. Now, over a year later, the children of Jeanne and Jimmy are filing a wrongful death lawsuit against the City of Lincoln and the utility company responsible for installing gas fixtures in their home, Black Hills Energy. Although the police still have not ruled out foul play, the Jasa children have commenced their tort action, and are seeking $4 million in compensation.

According to the complaint, “Black Hills infrastructure and its safety and warning devices failed to regulate the natural gas in the home and allowed the home to fill with gas.” Had Black Hills acted reasonably, according to the complaint, then Jeanne and Jimmy Jasa would still be alive. The children are represented by attorney Brian Jorde, who believes that the absence of criminal charges indicates that negligent behavior was responsible for the explosion.
